New Hampshire Seeks Dismissal of Suit Over Medicaid Reimbursement

December 9, 2011

Ten hospitals involved in suit

The state of New Hampshire is seeking a dismissal of a lawsuit filed by 10 hospitals over Medicaid reimbursement rates. The state claims it has the flexibility to set its own Medicaid reimbursement rates. If providers disagree, they can appeal to the Secretary of Health and Human Services.

Also reported in the December 9, 2011 NAHU Newswire is a story addressing the New Hampshire Hospital Tax Law. The Senate budget was assured that the state tax law will be upheld and that 2 hospitals that paid a lower tax based on federal guidelines will have to pay up. The state counted on receiving $197 million but only received $147 million. HHS commissioner is working with CMS to clarify that the state's tax has not changed.
