District of Columbia Appeals Judges to Rule on Healthcare Reform Lawsuit

September 26, 2011

PPACA is getting mixed reviews by federal appeals judges

The randomly selected three-judge panel will rule whether the law is constitutional. In a case brought by five people who did not want to purchase health insurance for religious reasons, challenged the law's requirement to purchase health insurance or face a penalty beginning in 2014. Judge Brett Kavanaugh questioned whether federal courts could rule on the law prior to a taxpayer being assessed a penalty. He went on to say, "in 220 years…Congress has never once mandated a purchase." The DC court may be the last to rule on the law prior to it reaching the U.S. Supreme Court.

Also reported in the September 26, 2011 NAHU Newswire is an article on Medicare Part D Plan rates decreasing around four percent.
