Supreme Court Denies Request for Health Law Expedited Hearing

April 26, 2011

Case will proceed through 4th Circuit Court of Appeals

The Supreme Court issued a ruling denying the request from Virginia Attorney General, Ken Cuccinelli for an expedited hearing on the Health Care Law. The court rarely takes cases for fast review. Now the case will have to make its way through the appeals process. Oral arguments are scheduled for May 10th. The case could make it to the Supreme Court in time for a Summer 2012 decision.

Including the Virginia case, there are four other Health Law cases on appeal: The Eleventh Circuit in Atlanta, the Sixth Circuit in Cincinnati, and the federal appeals court in Washington D.C.. It is expected these cases will eventually be appealed to the Supreme Court too.
