Administration Seeking Expedited Appeal

March 10, 2011

Asking the US Court of Appeals in Atlanta to speed its review of Judge Vinson's decision

The US Justice Department says expedition in the case is needed because of the district courts severability ruling that presents issues that the federal government had not previously addressed in appellate briefs. Because Judge Vinson declared the entire law unconstitutional, the federal government wants to know if the provisions that are taking place now can continue while the issue is under appeal, particularly in the 26 states that are a party to the action. A hearing could come as early as midsummer.

Also reported in the March 10, 2011 NAHU Newswire is a story from a "Healthwatch" blog estimating that the health reform tax on insurance plans could raise family premiums by $5,000 over a decade. Douglas Holtz-Eakin, former director of the Congressional Budget Office concluded that "consumers - small business and families - will shoulder the burden of these disguised taxes in the form of higher premiums for health insurance, reduced wages, and fewer resources available for hiring."
