Senator McConnell Plans to Join Suit

November 10, 2010

Challenging the constitutionality of the health reform law

Senate Minority Leader, Mitch McConnell plans to file a friend-of-the-court brief to join the multi-state lawsuit currently pending. The Commerce clause has been to regulate commerce not to compel economic activity. Senator McConnell says, "if the mandate is deemed constitutional, there will no longer be any real limit on Congress' power to regulate citizens' activity". He asserts that the requirement that most Americans purchase insurance oversteps the Commerce clause.

To help offset higher healthcare costs to lower paid employees, some companies are adopting a tiered system by which higher paid employees pay a bigger contribution towards their premium contribution.
