HHS Unable to Waive High Risk Pool Eligibility Requirements

No credible coverage the issue

Under the new health care reform law, individuals that enroll in the newly created high-risk pools must not have had credible health insurance coverage for the preceding 6 months. Connecticut Governor, Jodi Rell sent a letter to HHS Secretary Kathleen Sebelius asking for a waiver from the 6-month requirement. HHS responded advising there are certain eligibility requirements in the statute that they have no waiver authority and the credible coverage the preceding 6 months is one of them.
