| News Some States Considering State Constitutional Amendment to Ban Individual Mandate September 29, 2009 Legal challenges could cause delays in healthcare changes Some states are considering adding constitutional amendments that would outlaw the individual mandate requiring individuals to purchase health insurance. While some believe this is a symbolic move, others contend that this could create legal concerns and possibly delay any healthcare changes. President Obama claims that the mandate for an individual to purchase health insurance is not a tax but the Senate Finance Committee bill authorizes the IRS to collect a $1,900 "excise tax" if they do not purchase health insurance and if non compliant, could result in a $25,000 fine or prison time.
